Title 11 › Chapter CHAPTER 3— - CASE ADMINISTRATION › Subchapter SUBCHAPTER I— - COMMENCEMENT OF A CASE › § 305
A bankruptcy court, after notice and a hearing, may dismiss a case or pause all proceedings if doing so would better help the debtor and creditors, or if a petition under section 1515 to recognize a foreign proceeding has been granted and ending or pausing the case would better serve the purposes of chapter 15. A foreign representative may ask for dismissal or suspension under the second rule. Any order to dismiss or suspend, or a decision not to do so, cannot be reviewed on appeal by the court of appeals under sections 158(d), 1291, or 1292 of title 28, or by the Supreme Court under section 1254 of title 28.
