Title 11 › Chapter CHAPTER 5— - CREDITORS, THE DEBTOR, AND THE ESTATE › Subchapter SUBCHAPTER II— - DEBTOR’S DUTIES AND BENEFITS › § 528
Debt relief agencies must give anyone they start helping a written contract within 5 business days after the first time they provide bankruptcy help and before that person files for bankruptcy. The contract must plainly say what services will be done and how much will be charged, and the person must get a signed copy. When an agency advertises to the public about bankruptcy help, the ad must clearly say the help is for bankruptcy relief and must include a clear sentence that the business is a debt relief agency that helps people file for bankruptcy. Ads that describe Chapter 13 plans (even without naming Chapter 13) or that offer help with things like credit problems, foreclosure, eviction, heavy debt, debt collection, or trouble paying bills must also say the help may involve bankruptcy and include that agency statement.
