New-construction mortgages cannot be approved for insurance here if the housing does not have a public or adequate community water and sewer system. The only exception is for commitments made before August 10, 1965. The rule applies only where there is no system approved by the Secretary under subchapter IX–A as it existed before December 15, 1989, and local officials certify the area could economically get such systems. When deciding economic feasibility, do not consider whether local law or local approvals would allow building the systems.
