State limits on how much interest, discount points, finance charges, or other fees a lender can charge do not apply to certain loans made after March 31, 1980. That includes loans secured by the first mortgage or first claim on a house, loans secured by the stock for a dwelling in a cooperative housing corporation, and loans secured by the first mortgage on a residential manufactured home, when those loans meet rules like those in section 527(b) of the National Housing Act (with some specific changes for manufactured homes and lenders). State caps also do not apply to deposits, accounts, or other obligations of certain insured banks, savings banks, credit unions, Federal Home Loan Bank members, and insured housing institutions. A State may tell the federal government between April 1, 1980 and before April 1, 1983 that it does not want these rules to apply; if the State does so, the federal rule stops applying to loans made after that date except for loans made under commitments entered from April 1, 1980 until the State’s action and certain rollovers. States may still set limits on discount points or some other charges at any time after March 31, 1980. For loans on manufactured homes, federal rules must include consumer protections about balloon payments, prepayment penalties, late fees, and deferral fees; require a 30-day notice before repossession or foreclosure except in extreme cases; and require a fair refund on prepayment (at least the actuarial amount and not less than $1). The Federal Home Loan Bank Board must write the detailed rules and they had to take effect no later than 120 days after March 31, 1980. Key defined terms (one line each): "Prepayment" — paying off a loan early, refinancing, or a judgment. "Actuarial method" — the usual way to split payments between finance charge and principal. "Precomputed finance charge" — interest figured by add-on or discount methods. "Residential manufactured home" — a manufactured home used as a residence. The rule took effect April 1, 1980.
