An insured bank can count as a community development organization if it meets certain conditions. It must be a community development bank, control one, control a community development corporation or have a community development unit, put money into accounts at a low-income community development credit union, or join with other banks to run a community development group. Except for community development banks, the bank must invest at least the larger of 1/2 of 1 percent of its capital or the total it has already invested in that community group. The community group must make loans for home purchases, home repairs, and neighborhood development and provide other financial services to low- and moderate-income people, nonprofits, and small businesses in qualified distressed communities. Car loans and open-end credit plans are excluded. The federal agency may only approve a new community group if the area is not already served. A community development bank must have a 15-member Community Investment Board made up of local leaders. The bank’s directors first appoint that board, and afterward the board fills its own seats from community nominations. Board members serve one 2-year term, with the initial members staggered for 8, 16, and 24 months. One-third of the bank’s directors must be chosen from people the Community Investment Board nominates, and the bank’s directors must meet the Community Investment Board at least once every 3 months. Community development corporations or internal units must give equal or greater community participation. Definitions: community development bank = a depository institution; community development organization = a bank, corporation, unit, or credit union; low/moderate income, nonprofit, small business, and qualified distressed community are defined by other rules.
