Title 12 › Chapter CHAPTER 38A— - SINGLE FAMILY MORTGAGE FORECLOSURE › § 3751
Creates a single federal way for the Secretary to foreclose on certain 1- to 4-family residential mortgages. Congress found that many different State foreclosure rules slow things down, raise costs, let homes fall into disrepair, increase vandalism and fire risk, and hurt neighborhoods. Those delays and costs make it harder for the Secretary to protect the government’s financial interest and clog the courts. The law’s purpose is to provide a faster, uniform foreclosure method outside of court, with no right to redeem, for single‑family mortgages the Secretary holds under Title I or Title II of the National Housing Act or that secure loans the Secretary obligated under section 1452b of Title 42.
