§4007 Effect on State law

Title 12 › Chapter CHAPTER 41— - EXPEDITED FUNDS AVAILABILITY › § 4007

Last updated Apr 6, 2026|Official source

Summary

If a state law that was already in effect on September 1, 1989 made banks chartered by that state make deposited money available faster than the federal rules allowed (using the federal rules as they were on September 1, 1989), that state rule must be followed instead of the federal rule for how soon funds must be available. That state rule also applies to all federally insured banks in that state. For everything else, federal law and the Federal Reserve Board’s rules override any conflicting state law, including the state’s Uniform Commercial Code.
