By June 30 of each year, the Bank must send a report to the House Committee on Financial Services and the Senate Committee on Banking, Housing, and Urban Affairs. The report must describe how the Bank followed two specific sentences in section 635(b)(1)(A). It must survey other major government export-financing programs (including market windows), compare their rates, terms, and estimated annual financing amounts with the Bank’s, and report experiences of U.S. exporters and commercial lenders facing that competition. The report must also explain the Bank’s role in the Trade Promotion Coordinating Committee strategic plan (section 4727 of title 15), include the report required by section 635i–3(g), classify all Bank transactions by their main purpose, and describe financing for renewable energy projects with a year-to-year comparison. It must contain a section comparing the size of the Bank program account with other major program accounts and, if appropriate, recommend size changes; describe co‑financing programs and list countries with export credit co‑financing memoranda; and describe Bank support for services and how that compares to other facilities. The Bank must give details on reported cases that may break the Arrangement (see section 635i–3(h)(3)) or exploit its loopholes, and describe where foreign export agencies (including those not in the Arrangement) may violate the Arrangement or the Agreement on Subsidies and Countervailing Measures (see section 3511(d)(12) of title 19) and what U.S. actions were taken. The President of the Bank, after consulting the Secretary of the Treasury, may send the sensitive details about noncompliance or loophole cases and about foreign-agency violations in a separate confidential report instead of in the main report. Any Board member may add comments for inclusion.
