The Secretary can take a Reserve officer off active duty if the officer fails selection for the next higher grade two times. The Secretary must take off active duty any Reserve officer who is a captain, has completed 30 years of total commissioned service, and is not on the approved list for promotion to rear admiral (lower half). If an officer has two failed selections but is kept on active duty, the Secretary decides how long they stay. Under section 12646 of title 10, an officer removed from active duty may transfer to the Retired Reserve if eligible. If not retired, the Secretary can move them to the inactive list or discharge them. The transfer or discharge happens on the June 30 after the board approval date for the second failure, or on the June 30 after the date the captain completes 30 years. Total commissioned service is counted from the date a Reserve officer accepted appointment as an ensign, with special rules for those first appointed above ensign.
