Title 14 › Subtitle SUBTITLE I— - ESTABLISHMENT, POWERS, DUTIES, AND ADMINISTRATION › Chapter CHAPTER 9— - ADMINISTRATION › Subchapter SUBCHAPTER II— - MISCELLANEOUS › § 938
The Secretary can handle and settle maritime damage claims that would be heard in U.S. district courts, and claims for damage caused by a vessel or floating object to U.S. property that the Coast Guard controls or has agreed to respond to. The Secretary may accept money to resolve those claims, and only when payment is accepted does the settlement become final and binding. Payments must go into the U.S. Treasury as miscellaneous receipts. The Secretary can sign a full release for the claim. This authority adds to, but does not replace, other settlement laws. No settlement under this authority may involve a net payment over $425,000.
