Within 180 days after November 10, 1978, the Commission must set up a Toxicological Advisory Board to give scientific and technical advice about warning labels for hazardous substances. The Board must focus on proper labeling, especially how to describe precautionary steps, how to state the hazards, and what first-aid instructions to include. It also advises when certain substances can be left off labels. The Board must review any existing labeling rules, send the Commission recommendations for changes within one year after it is created, and keep checking and updating its advice as scientific knowledge changes. The Board will have nine members chosen by the Commission. Members must have relevant training and experience, and at least three must belong to the American Board of Medical Toxicology. The Board elects its own chair. Members serve three-year terms and can be reappointed; vacancies are filled the same way and appointees finishing a term serve only the remainder. The Board must meet at least twice a year. Nonfederal members may be paid up to the daily equivalent of the GS–18 rate and get travel expenses, but they are not federal employees because of that pay. The Board ends six years after it is set up.
