Defines the key words used in the rules about asbestos in buildings. An "accredited asbestos contractor" is someone accredited under section 2646. "Administrator" means the head of the Environmental Protection Agency. "Asbestos" means the six asbestiform minerals listed in the law: chrysotile, crocidolite, amosite, anthophyllite, tremolite, and actinolite. "Asbestos-containing material" means any material with more than 1 percent asbestos by weight. The "Guidance for Controlling Asbestos-Containing Material in Buildings" is the EPA document with that title as of March 31, 1986, and the "most current guidance document" is that same Guidance as later changed. Other terms: "friable asbestos-containing material" is material that can be crumbled to powder by hand when dry (including formerly non-friable material that becomes damaged). "Local educational agency" includes the agency in 20 U.S.C. 7801, owners of private nonprofit school buildings, and authorities running Defense Dependents’ Education Act of 1978 (20 U.S.C. 921 et seq.) schools. "Non-profit elementary or secondary school" means a school run by a nonprofit with no private shareholders. "Public and commercial building" means any non-school building, but not a residential apartment building with fewer than 10 units. "Response action" means methods to protect people and the environment from asbestos (including methods in chapters 3 and 5 of the Guidance). "School" and "school building" follow the education definitions in 20 U.S.C. 7801 and include classrooms, labs, libraries, cafeterias, gyms for physical education, instruction or admin buildings, and needed maintenance or utility areas. "State" lists the State, District of Columbia, Puerto Rico, Guam, American Samoa, the Northern Marianas, the Trust Territory of the Pacific Islands, and the Virgin Islands.
