The Secretary of Commerce must charge other federal agencies for any service the Institute provides to them under any law that names the Secretary or the Institute as a consultant or asks them to help, whether the law was passed before, on, or after October 6, 1982. Charges do not apply when funds are specifically appropriated to the Secretary or the Institute to perform the service. The Secretary can waive a fee if the Institute’s cost is only nominal. Costs are figured under section 278b(e).
