Franchisors must give a written notice to a franchisee before ending or not renewing the franchise. The notice usually must be sent at least 90 days before the end date. It must be sent by certified mail or handed to the franchisee and must say they intend to end or not renew, give the reasons, state the date it takes effect, and include a short government summary of rights and remedies. If it is not reasonable to give 90 days’ notice, the franchisor must give notice as soon as it is reasonably possible. For leased marketing sites, the franchisor cannot set up a new franchise at that location for 30 days after the notice is posted or handed over (or after the effective date, if that is later). In some special cases the notice period is 180 days, and the franchisor must also send a copy and a withdrawal plan to the Governor of each affected State. The Secretary of Energy had to publish the required summary by 30 days after June 19, 1978; if notices were given before that publication, the summary may be provided within 5 days after publication.
