§3207 Judicial review and enforcement

Title 15 › Chapter CHAPTER 59— - RETAIL POLICIES FOR NATURAL GAS UTILITIES › § 3207

Last updated Apr 6, 2026|Official source

Summary

Federal courts normally cannot hear lawsuits about these rules. Two exceptions exist. The Secretary can sue in a U.S. court to enforce the Secretary’s right to intervene under section 3205, and that court can give relief. Also, the U.S. Supreme Court may review cases under sections 1257 and 1258 of title 28. Anyone can sue in the proper State court to enforce the rules, following state procedures. The Secretary may not appeal or ask for court review of decisions by a State regulatory authority or a nonregulated gas utility, and may not join suits to do that. The Secretary may only take part as a friend of the court (amicus curiae) in such reviews.
