Breaking the rules in section 4402 or the rules made under this chapter is treated the same as breaking section 45. Anyone who breaks section 4402 or 4403(a) is guilty of a misdemeanor and can be fined up to $10,000. Rules the Federal Trade Commission issues under section 4402 must follow section 553 of title 5, and the Commission had to create any required rules no later than 180 days after February 27, 1986. Except for the duties in sections 4402 and 4403, nothing else in this chapter changes the FTC’s power over unfair or deceptive smokeless tobacco advertising.
