Enforcement cases must start before the later of September 30, 1988, or six years after the violation happened. Definitions: "commencement of a civil enforcement action" means either issuing a proposed remedial order to the Department of Energy’s Office of Hearings and Appeals or filing a complaint in a U.S. district court. "Civil enforcement action" means an administrative or court action by the Secretary to enforce the Emergency Petroleum Allocation Act of 1973 or the Economic Stabilization Act of 1970. Some periods are not counted when figuring those deadlines. Time is paused if a person is outside the United States, hiding, or not reachable; if key facts could not be known; while waiting for full compliance with a subpoena or special report and up to 12 calendar months after that; while a related criminal case is pending and up to 12 months after its final order or dismissal; before a final agency decision on an adjustment request and up to 12 months after that; or when the Secretary and the defendant agree in writing to an extension. Actions remanded by certain agencies are not affected. Congress said the Secretary and the ERA Administrator should move quickly on known prelitigation cases, not delay for settlements, and get help from the Department of Justice. After January 1, 1987, the Secretary cannot start new audits or investigations just to begin enforcement actions, with narrow exceptions for ongoing matters. Court challenges to final agency actions must start within 60 days after the action’s effective date or within 90 days after October 21, 1986. The Secretary must keep ERA staffing at 170 full-time equivalents for fiscal 1987, report yearly on staffing needs by July 1, give 30 days’ notice before staff cuts, and keep Congressional committees informed about case status.
