Title 15 › Chapter CHAPTER 72A— - CREATING HELPFUL INCENTIVES TO PRODUCE SEMICONDUCTORS FOR AMERICA › § 4654
Not later than 180 days after January 1, 2021, the Secretary must lead a review and survey, using authorities in section 4555 of title 50 and working with other federal agency heads (including Defense, Homeland Security, and Energy). The survey must get replies from U.S. companies, any company with a physical presence in the United States, and foreign companies that have a U.S. presence. It must collect at least 12 kinds of information about how those companies design, make, and use microelectronics, including where they operate, cost structures, equipment they use, sources of parts and materials, product specs and end uses, sales and financial data, subsidies or incentives received, any requests for proprietary information by Chinese state actors, partnerships or licensing deals, joint ventures, and steps they take to manage supply‑chain risks. The Secretary must report the review results to Congress after consulting with other agencies. The report must assess the findings, list critical technology areas that could be hurt by microelectronics disruptions and the effects of such disruptions, and describe gaps and vulnerabilities in the supply chain and U.S. industrial base. The report may be submitted in classified form.
