The Federal Trade Commission must make rules to stop misleading or unfair ads for pay-per-call phone services. Ads must clearly show the cost (total or per minute) and any other fees, and must tell the odds or how odds are decided when a prize, free, or reduced offer is made. If a service gives information about a federal program but is not run or approved by a federal agency, the ad must say that at the start. Ads cannot target children under 12 unless the service is a real educational service. Ads aimed at people under 18 must say parental permission is required. Ads may not use automatic dialing tones to call pay-per-call numbers, and they cannot advertise toll-free numbers (like 800) that actually connect to paid services. When a number appears in print or TV, the price must be shown clearly and, on TV, for the same time the number appears. Pay-per-call providers must play an introductory message that explains the service, states the cost and when charges start, says parental consent is needed for kids, and says they are not a federal agency if that applies. Callers must be able to hang up before charges begin. Providers must stop charging when the caller hangs up, limit billing to what was promised, show pay-per-call charges separately on bills with service type, amount, date, time, and duration, and give refunds for violations. The rules must prevent evasion, require carriers to share records with the FTC, may allow some exemptions for frequent callers or very low charges, and may require automatic disconnects or beeps in live programs. The FTC had to issue these rules within 270 days after October 28, 1992. Breaking the rules is treated as an unfair or deceptive practice under section 45, and common carriers are subject to the FTC for this.
