State laws about telephone billing still apply unless they clash with this federal law. The Commission decides if a state law conflicts. The Commission cannot say a state law conflicts when that law gives consumers more protection. The Commission must create a rule that lets it exempt whole types of phone-billed purchases in a state when the state’s rules are basically the same as the federal rules or give greater consumer protection, and when the state has adequate enforcement.
