Title 15 › Chapter CHAPTER 88— - INTERNATIONAL ANTITRUST ENFORCEMENT ASSISTANCE › § 6203
A U.S. district court can order someone who lives in, is found in, or does business in that district to give testimony, make a statement, or hand over documents to the Attorney General. The Attorney General must be acting under an antitrust help agreement with a foreign competition authority. The order can be used to decide if a person violated or is about to violate foreign antitrust laws, or to help enforce those laws. The court can appoint a person to take the testimony and give oaths. The court can set how testimony and documents are collected. It may follow the foreign authority’s procedures, or, unless the court says otherwise, use the Federal Rules of Civil Procedure. No one can be forced to give testimony or documents that would violate a legal right or privilege. People may also voluntarily help a foreign authority.
