Contraband oil shipped between states in violation of this chapter can be seized by a U.S. district court where it is found and taken by the United States through a court claim. The court can, if it finds undue hardship, return the oil to the owner under conditions it sets. The case is handled like a maritime seizure, but either side can ask for a jury trial on factual questions. Forfeited oil will be used or disposed of under rules the President makes. If the owner (not the shipper who broke the law) has a seemingly valid certificate of clearance from a board under section 715d saying the shipment is not contraband, and the owner had no reasonable reason to doubt that certificate, then the oil cannot be forfeited.
