People, states, cities, or state agencies that are parties and unhappy with an order by the Commission can ask for a rehearing within 30 days after the order. The request must say the exact reasons for asking. The Commission can grant, deny, change, or cancel its order without another hearing. If the Commission does not decide the rehearing request within 30 days after it is filed, the request may be treated as denied. You must ask the Commission for rehearing before you can go to court. After the Commission rules on rehearing, a party can file a petition in the U.S. court of appeals within 60 days asking the court to change or set aside the order. The court gets the Commission’s record and then has the power to affirm, change, or cancel the order. The court normally will not consider complaints that were not raised in the rehearing unless there was a good reason. If supported by substantial evidence, the Commission’s findings of fact are final. The court may allow new evidence if it is important and there was a good reason it was not offered earlier. Filing for rehearing or filing in court does not automatically pause the Commission’s order unless the Commission or the court specifically orders a stay. For projects covered by sections 717b or 717f, the U.S. court of appeals in the circuit where the facility would be built has the original and exclusive authority to review federal or state agency actions on required federal permits (not including the Coastal Zone Management Act). The D.C. Court of Appeals has original and exclusive authority when an agency fails to act. If the court finds the agency’s action or inaction breaks federal law and would stop the project, the court must send the matter back to the agency with a schedule and deadline for action. The Commission must file the consolidated record for these cases, and the court must handle them on an expedited schedule.
