The Commission can make rules to carry out this Act, except for the changes made by sections 4 and 12. Any rules it makes must follow the rulemaking process in section 553 of title 5. Those rules cannot let the Commission require that commercial email messages use specific words, symbols, marks, or labels. The rules also cannot force the identification called for in section 7704(a)(5)(A) to appear in any particular part of the email (for example, the subject line or the body).
