Title 15 › Chapter CHAPTER 113— - CONCRETE MASONRY PRODUCTS RESEARCH, EDUCATION, AND PROMOTION › § 8707
A person who is under an order can ask the Secretary to change the order or to be exempted. The person must say the order, a part of it, or any duty tied to it was not made under the law. The Secretary must offer a hearing under rules the Secretary makes. After the hearing, the Secretary will make a decision. Any challenge must be filed at least 2 years after the order, provision, or duty went into effect. If the person disagrees with the Secretary’s decision, they can ask a U.S. district court where they live or do business to review it. That court complaint must be filed within 30 days after the Secretary’s decision. Legal papers must be served under the Federal Rules of Civil Procedure. If the court finds the Secretary’s decision unlawful, the court will send the matter back and tell the Secretary to make a lawful decision or take other actions the law requires. While these proceedings go on, they do not stop the Attorney General or the Secretary from getting other legal relief under the law.
