Anyone who knowingly breaks a rule of this law or a related permit or regulation can be criminally punished. If convicted, a person can be fined up to $20,000, jailed for up to one year, or both. The Secretary can also impose a civil fine of up to $10,000 for each violation. Before a fine is imposed, the person must get notice and a chance for a hearing that follows the rules in section 554 of Title 5. The Secretary can subpoena witnesses and papers and swear witnesses; witnesses get the same fees and travel pay as in U.S. courts. A federal court can force compliance with subpoenas and punish refusals. The Secretary may reduce or cancel a fine for good cause. If a fine is not paid, the Secretary can ask the Attorney General to sue in federal court where the person is found, lives, or does business to collect it.
