Title 16 › Chapter CHAPTER 27— - NATIONAL TRAILS SYSTEM › § 1243
The Secretary of the Interior or the Secretary of Agriculture can create and name national recreation trails. They must have permission from the federal agency, state, or local government that manages the land. They can do this if the trail is reasonably close to a city or if it meets the rules in this chapter and any extra rules the Secretary sets. Trails in parks, forests, or other federal recreation areas can be named by the right Secretary. If the government is not acquiring the land, the Secretary must get consent: from state or local agencies for urban-accessible trails, from the State for state-owned recreation areas, or written permission from the private landowner for trails on private property.
