Title 16 › Chapter CHAPTER 30— - WILD HORSES AND BURROS: PROTECTION, MANAGEMENT, AND CONTROL › § 1333
The Secretary must protect and manage all wild free-roaming horses and burros on public lands. He can set up protected ranges after talking with the State wildlife agency and the Advisory Board. He must keep their populations at levels that let the land and other wildlife stay healthy. Management should be as limited as possible and done with advice from State agencies and independent scientists. The Secretary must keep a current count of animals to see if there is an overpopulation and to set appropriate management levels. He must consult the U.S. Fish and Wildlife Service, State wildlife agencies, experts recommended by the National Academy of Sciences, and other qualified scientists. If an overpopulation exists, he must remove excess animals right away in this order: humanely destroy old, sick, or lame animals; capture and remove animals for adoption (no more than four animals per person per year unless the Secretary allows more); and humanely destroy any remaining excess animals. He must also fund a research study, designed by a National Academy of Sciences panel, and submit it to Congress by January 1, 1983. Animals given for adoption that are cared for humanely for one year may have title transferred (up to four animals per person). Animals stop being covered by this law when title passes, when they die after transfer before title, when they are destroyed under removal rules, or when they die and are properly disposed of. Any excess animal older than 10 years or unsuccessfully offered for adoption three times must be sold, including by auction until sold or until the proper population level is reached. Money from those sales must go to the Management of Lands and Resources appropriation for the Bureau of Land Management and be used for adoption costs and marketing.
