§2106a Emergency reforestation assistance

Title 16 › Chapter CHAPTER 41— - COOPERATIVE FORESTRY ASSISTANCE › § 2106a

Last updated Apr 6, 2026|Official source

Summary

The Secretary of Agriculture can help landowners replant or recover commercial tree stands when at least 35% of the trees are lost because of damaging weather, a related problem, or wildfire. Help can be either a payment that covers up to 65% of the replanting costs above the first 35% loss, or, at the Secretary’s choice, enough tree seedlings to reestablish the stand. No one can get more than $25,000 in a fiscal year (or the same value in seedlings). People with more than $2,000,000 in annual gross revenue cannot get these benefits. The Secretary must write rules that define who counts as a person, make fair limits, and prevent duplicate federal payments. Key terms: damaging weather (examples: drought, hail, freeze, hurricane, wind, tornado, excess moisture); eligible landowner (three size-based categories of tree or private forest ownership); qualifying gross revenues (use farm/ranch/forest income if it’s most of a person’s income, otherwise use all income); related condition (insects, disease, or deterioration made worse by weather); reestablish (site prep, replanting, and approved stand improvements); wildfire (any forest or range fire). Reimbursements only cover approved practices done on or after September 1, 1989 and before November 28, 1990.
