Title 16 › Chapter CHAPTER 42— - EMERGENCY CONSERVATION PROGRAM › § 2201
The Agriculture Secretary may pay farmers or ranchers who take emergency steps to stop wind erosion or to repair land damaged by wind, floods, hurricanes, wildfires, or other natural disasters. Payments can be made only when the damage creates new conservation problems that would harm the land or cut its productivity, are unusual (except wind erosion), and are so costly that federal help is needed to restore farm use. For fence repair or replacement, a producer can choose to get up to 25% of the payment up front. If that advance is not spent within 60 days, it must be returned within a reasonable time set by the Secretary.
