The Secretary may add land and water to the Barataria Preserve by donation, purchase (with donated or appropriated money), transfer from other federal agencies, or exchange. Any non‑federal land shown on the park map as “Lands Proposed for Addition” can only be bought with the owner’s OK. When such a parcel is acquired, the preserve boundary is changed. Any acquired land must follow easements agreed with the Secretary and the Army for hurricane protection. Starting March 30, 2009, federal land shown as “Lands Proposed for Addition” was moved at no cost into National Park Service control as part of the unit. The Secretary can also get land or leases in the French Quarter for a visitor and office facility. State or local government land can only be taken by donation. Oil and gas rights cannot be taken without the owner’s consent, and their use may be limited by Park Service rules. The Secretary must protect fresh water drainage, plant cover, ecosystems, and water and air quality in the preserve. With the owner’s and parish’s agreement, the Secretary may add nearby land and water (including using Land and Water Conservation Fund money) and change the preserve’s boundaries. The Secretary may also acquire, by donation, purchase, or exchange, up to approximately 20 acres in Acadian villages and towns to be part of the Jean Lafitte National Historical Park and Preserve.
