Each year, the chapter applies to any electric utility that, in any calendar year after December 31, 1975 and before the year just before the current year, sold more than 500 million kilowatt‑hours for purposes other than resale. The rules do not apply to parts of a utility’s operations or proceedings that deal with sales for resale. Before each calendar year, the Secretary must publish a list of the covered utilities, and each State regulator must quickly tell the Secretary which listed utilities it has ratemaking authority over.
