The Secretary of the Interior has full authority to make and enforce rules for hot-water use and bathhouses at Hot Springs National Park. The Secretary can allow park superintendents to inspect how hot water is used to stop waste, set reasonable maximum prices for baths, bathing services, and guests at the Arlington Hotel, and make other rules and penalties to protect the public interest. Those penalties can be enforced as if they were laws. All hot-water leases and grants must follow rules that were in place on March 3, 1891 or any new rules the Secretary makes. If an owner knew about a rule and broke it, the Secretary can cancel the lease. Leases must say a bathhouse cannot be owned or controlled by anyone who also owns or has an interest in another nearby bathhouse. Transfers or assignments need the Secretary’s written approval, and if control is transferred to someone who owns another nearby bathhouse, the Secretary may stop the hot-water privilege and cancel the lease. New buildings in the park must use plans the Secretary approves and must be made fireproof as nearly as possible.
