To join the conservation stewardship program, a producer must send the Secretary a contract offer showing they already meet or beat the stewardship score for at least 2 priority resource concerns and that, by the end of a 5-year contract, they will meet at least 1 more by adding new conservation actions and improving existing ones across the whole farm. The Secretary ranks offers by the current conservation benefits, how much the proposed actions will improve those benefits, and other fair criteria the Secretary sets. If offers tie, the Secretary prefers the one that gives the same benefits at the lowest cost. The Secretary cannot favor someone just because they want a smaller payment. If an offer is approved, the Secretary signs a 5-year contract that names the yearly payment. The producer must follow a conservation plan, give information needed to show they are following the plan, and avoid actions that hurt the plan’s goals. Normal farming and other uses that keep the land agricultural are allowed if they fit the plan. Contracts include protection for problems beyond the producer’s control (like disasters). If a producer breaks the contract, the Secretary can end it and may cancel future payments or require repayment and damages. A transfer of the land usually ends the contract unless the new owner agrees to take over, is eligible, and the Secretary approves. The Secretary can also change or end a contract if it serves the public interest or the producer agrees. During the first half of the fifth year, a producer who has followed the contract may be offered a new 5-year contract if they agree to keep improving conservation across the whole operation and, by the end, meet 2 more priority concerns or raise performance on 2 specified concerns.
