The Secretary can stop or hold back money for certain Lowell park projects if certain problems happen. The money can be withheld if the city of Lowell does not adopt required rules within one year after the standards are set (the Secretary can extend that deadline by up to six months if the city shows a good faith effort). The money can also be withheld if the city fails to tell the Commission about building permit or zoning variance applications for properties on the official index, or about proposed changes to those rules. Money may also be withheld if the city issues permits or takes actions affecting park or preservation district property that the Secretary or the Commission think break the standards or the city’s rules, either before or after those rules are put in place. Finally, the Secretary can withhold funds if the Commission does not make good faith efforts to preserve, restore, manage, develop, or maintain property in the park and preservation district or to carry out the approved park preservation plan.
