Title 16 › Chapter CHAPTER 1— - NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › Subchapter SUBCHAPTER LIX–E— - BISCAYNE NATIONAL PARK › § 410gg–1

Last updated Apr 6, 2026|Official source

Summary

Within the park boundary, the Secretary may acquire land, water, and property rights by donation, by buying with donated or appropriated money, or by exchanging property. Land owned by the State of Florida or its local governments may only be accepted as a donation and must follow any Florida law limits. Federal lands already under the Secretary’s control are moved to the National Park Service to be managed for the park. Federal lands controlled by other agencies will be transferred to the Secretary when those agencies no longer need them. Congress expects the Secretary to mostly finish the land-acquisition program within three complete fiscal years after the subchapter goes into effect. Property owners may tell the Secretary they want their land bought, and the Secretary must give those requests prompt and careful consideration, depending on available funds.
