If someone knowingly breaks section 4223, they can be criminally punished: fined under Title 18, jailed for up to one year, or both. The Secretary can also impose civil fines up to $5,000 for each violation, using the procedures in section 1540(a). If money is provided, collected penalties can pay rewards under section 4225 and any leftover goes into the Fund. Enforcement follows the rules in section 1540.
