The Secretary of the Interior can use federal condemnation (legal taking by court order) to acquire land, land interests, or related rights inside the battlefield for the United States. The U.S. may take possession when a condemnation petition is filed in the United States District Court for the District of Maryland. If an owner names a price the Secretary finds reasonable, the Secretary may buy it immediately, may accept donations of land or rights, and must be satisfied with the title.
