When the government buys land or water, the Secretary must let the seller keep some or all of the oil, gas, and similar underground minerals and may let them use as much of the surface as needed to remove those minerals, following rules the Secretary sets. The purchase must not cancel or reduce any surface rights in grants, leases, or easements that existed on April 11, 1961, if those rights are reasonably needed for exploring, producing, storing, processing, or moving oil and gas taken from outside the national seashore; the Secretary can also allow extra surface use under rules.
