§4725 Relationship to other laws

Title 16 › Chapter CHAPTER 67— - AQUATIC NUISANCE PREVENTION AND CONTROL › Subchapter SUBCHAPTER III— - PREVENTION AND CONTROL OF AQUATIC NUISANCE SPECIES DISPERSAL › § 4725

Last updated Apr 6, 2026|Official source

Summary

Federal agencies must follow all applicable federal, State, and local environmental laws when they carry out section 4722 of this title. States and their local governments can make and enforce measures to control aquatic nuisance species and keep their authority over fish and wildlife. But any release that happens during normal ship operations—including ballast water as defined in subsections (a) and (p)(1) of section 1322 of title 33—must follow section 1322 of title 33. Obeying a State’s control or eradication rules does not free anyone from also following the rules in this subchapter.
