Either party in a land exchange can keep rights to timber, minerals, or easements. The value of those kept rights must be counted when valuing the lands. If land is given to the United States, the Secretary of Agriculture can set reasonable rules for access and surface use. If the United States keeps mineral rights, the miner may use needed surface area to mine but must pay for any damage. All kept rights are subject to state tax laws.
