The Secretary must regularly review trade in exotic birds that are not listed under the Convention. After giving public notice and a chance to comment, the Secretary can stop or limit imports (a moratorium or a quota) in two situations. First, the Secretary can act for a particular species from one or more countries if the official findings in section 4905(c)(2), (3), and (4) cannot be made and the stop or limit is needed to protect the species or fits the law’s purpose. Second, the Secretary can stop or limit all exotic bird imports from a country if that country has not put in place a management program for bird trade that ensures conservation and humane treatment during capture, transport, and care, and the stop or limit is needed to protect the species or fits the law’s purpose. The Secretary must end any moratorium or quota if the reasons for it no longer exist.
