Title 16 › Chapter CHAPTER 70— - NORTH PACIFIC ANADROMOUS STOCKS CONVENTION › § 5008

Last updated Apr 6, 2026|Official source

Summary

The Secretaries of Commerce and Transportation must enforce this law. They may use other federal or state agencies, including Defense, and borrow people, equipment, and facilities on a paid or unpaid basis through agreements. They and agency heads who sign such agreements can authorize officers to enforce the Convention, this law, and its rules. Any agreement or contract only counts to the extent money is provided in advance by appropriations Acts. Only the United States district courts can hear cases under this law. Authorized officers, shoreward of the outer boundary of the exclusive economic zone or while in hot pursuit from that zone, may, with or without a warrant, arrest people suspected of violating section 5009, board and inspect fishing vessels covered by the Convention and this law, and seize vessels (with gear, stores, and cargo), fish taken in violation, and other evidence. They can also carry out warrants and use other lawful powers. In the Convention area, officers may board vessels of any Party believed to be fishing for or processing anadromous fish, inspect equipment, logs, and catch, question people, and, if there is a violation or good reason to believe one occurred, arrest or seize and investigate. Officers may also appear as witnesses and provide records when requested by another Party.
