The Secretary of Agriculture may sell forest-tree seed and nursery stock to States, local governments, and public agencies of other countries. Sales must follow any conditions the Secretary sets and must charge at least the United States’ actual or estimated cost to obtain or grow the seed or stock. Money from sales goes into the Forest Service fund used to buy or grow seed and stock. The Secretary may also trade seed or stock with those agencies if the trade is in the U.S. interest and what is given is not worth more than what is received. Nursery stock sold or traded under this rule cannot be ornamental or common landscape plants sold by commercial nurseries.
