When the Commission tells the federal Secretaries that a coastal State failed a review, the Secretaries must decide together within 30 days whether the State is following the coastal fisheries Plan. They must consider comments from the Commission and the State. If the State is not following the Plan, the Secretaries must declare a moratorium — a ban — on fishing for Atlantic striped bass in that State’s coastal waters. During a moratorium it is illegal to fish in the moratorium area; to land striped bass caught in violation; to land striped bass in that State while the moratorium applies; or to keep striped bass that are caught incidentally — they must be returned to the water no matter their condition. Violators can be fined, and vessels, gear, and fish used in violations can be seized and forfeited. Authorized federal or Coast Guard officers may enforce the ban, and the Secretaries can make rules to carry it out.
