If the Colorado State Land Board offers to transfer some or all of its lands inside the Protection Area, the Secretary must quickly try to work out a purchase or land trade with the Board. For lands in the Jim Creek drainage inside the Protection Area, the Secretary must negotiate with the owners to buy or trade the land, but the government cannot take those lands without the owner’s consent. Landowners keep their rights, including reasonable access by vehicles or other means as agreed with the Forest Service and allowed by law. The Secretary must send a report to the House Committee on Resources and the Senate Committee on Energy and Natural Resources when an agreement is reached or by one year after August 21, 2002, whichever comes first (for both kinds of lands). The report must say how much money is available for buying the land and whether more funds are needed. Any lands bought after August 21, 2002 that lie inside the James Peak Wilderness or the Protection Area must be added to and managed as part of those areas.
