The Secretary may buy or otherwise obtain lands, waters, or rights in the Area. Except for the estuary and its wetlands, the Secretary must not take land or rights without the owner’s permission so long as the owner uses and maintains the land substantially the same way it was on June 1, 1974. If the land is in imminent danger of being used differently than it was on June 1, 1974, the Secretary may acquire it without permission. For the estuary and its wetlands, the Secretary may acquire land without the owner’s permission at any time, but only after a public hearing. Within 180 days of December 22, 1974, the Secretary must publish rules saying what counts as a substantial change in use or maintenance for land not owned by the federal government. Owners of such land must give at least 30 days’ notice to the Secretary before making any substantial change, following those rules.
