The Secretary must run the Preserve following National Park Service rules, the cooperative agreements, and other park laws. With a private owner’s permission, NPS rules can apply to private land inside the Preserve. With owner approval, the Secretary can build, fix, or improve needed buildings, roads, trails, and visitor facilities on private property by direct work or by contract. Claims against the United States for harm are handled under the Federal Tort Claims Act. The Secretary can include in cooperative agreements a promise to defend and pay for claims against a landowner up to $3,000,000 per claimant per occurrence, but not for harm caused by the landowner’s wanton or willful misconduct. The Preserve is a unit of the National Park System and may charge entrance and admission fees. The Secretary can spend federal money and accept donations (but not land) to help manage private property in the Preserve for research, resource work, and visitor protection. The Secretary must prepare and send a general management plan not later than the end of the third full fiscal year beginning after November 12, 1996. The plan must be made after consulting the Trust, the Advisory Committee, nearby landowners and communities, and Kansas state agencies. The plan must cover keeping and improving the tallgrass prairie; public access that matches conservation needs; educational programs about the prairie, Native American history, and ranching; state fence rules (and pay extra costs if NPS requires stronger fences); state rules on noxious weeds, pesticides, and animal health; state water and waste laws; honoring oil and gas leases in effect on November 12, 1996; and offering grazing agreements to people who had grazing rights on that date. The Secretary may allow hunting and fishing on federal lands in the Preserve and must include a financial plan showing how fees, private donations, and other non‑Federal money could fully support management.
