The Secretary may make rules as needed under section 553 of title 5. Those rules must follow this chapter and, for enforcement steps, be made after talking with the Secretary of the department that runs the Coast Guard. The Secretary, with that Coast Guard Secretary, may name and announce which ports ships may use, but cannot pick a port that is not also a customs port under section 1433 of title 19 or not listed in an international fisheries agreement. The Secretary must notify a vessel’s flag nation—and, when appropriate, the vessel master’s country, nearby coastal nations, regional fisheries organizations, the UN Food and Agriculture Organization, and other relevant international groups—about denials or withdrawals of port entry or services under section 7404, enforcement actions under section 7405, and inspection results. The Secretary may also ask a vessel’s flag state to confirm that the fish on board were caught under applicable RFMO rules.
