Requires a utility ordered to provide wholesale transmission to charge rates and set rules that let it recover all reasonable costs of giving that service. The rates must be fair, promote efficient use of the grid and generation, and not treat parties unfairly. When possible, the person who asked for the order must pay the costs that are properly tied to the new transmission service instead of the utility’s existing customers. Before a final order, the Commission will issue a proposed order and give the parties a set time to agree on costs and terms. That proposed order cannot be challenged in court. If the parties agree and the Commission approves, those terms go into the final order. If they do not agree, the Commission will set the terms. If the Commission denies an application, it must explain why. Orders cannot override state laws about retail service areas. Orders cannot force transmission directly to a final customer, or to someone who would sell directly to final customers, except for certain public agencies and other listed types of entities that were serving those customers on October 24, 1992 (with one special-date exception tied to October 1, 1991). For the Tennessee Valley Authority, any order that makes TVA act waits 60 days and may trigger a special hearing about a separate TVA law; court review of that TVA decision is limited and time‑bound. For the Bonneville Power Administration, the Commission can order transmission and set terms but must respect other federal laws and not weaken BPA’s ability to serve the Pacific Northwest. In the ERCOT region, non-public utilities actually used must be paid under the Texas Public Utility Commission’s ratemaking method when practicable. Antitrust laws and other Commission powers remain fully in effect.
